The grant of short-term patents in Hong Kong, China is based on inspection reports prepared by one of the international inspection authorities or one of the designated patent authorities. Utility model patents applied for in mainland China can apply for short-term patents in Hong Kong within a 12-month priority period. After passing the examination, registration will be granted and a registration certificate will be issued, which will be announced in the Gazette.

1、 Required documents for application

1. The name or address of the applicant, the name or address of the inventor, and the Chinese and English names of the invention;

2. Application documents (including: specification, claims, drawings, abstract, and English translation of the abstract);

3. If claiming priority, please submit a priority statement and relevant priority documents;

4. Hong Kong short-term patent search report (issued by the China National Intellectual Property Administration).  

5. If you are not the inventor, you need to submit a statement indicating that you are entitled to a short-term patent;

2、 Application time:

1. Required time: 6-9 months

2. Validity period: 4 years from the submission date of the application, with a maximum validity period of 8 years.

3. After approval, the renewal fee must be paid within 3 months before the expiration of the 4th year from the application date, and the validity can be maintained for another 4 years.
